Are AI guardrails mandatory in Australia? The 2026 position, with sources
Short answer: no general AI law applies yet. The 10 guardrails in the Voluntary AI Safety Standard (September 2024) are voluntary. On 21 October 2025 they were evolved into the Guidance for AI Adoption (6 essential practices), which is also voluntary.
- The National AI Plan (2 December 2025) relies on existing, technology-neutral laws and sector regulators, and set up an AI Safety Institute, which is not a regulator.
- The government has said it intends to legislate standards for large data centres and AI training in early 2027. That is a proposal, not law.
- What is law: the Privacy Act, including the automated-decision transparency rule from 10 December 2026, consumer law, anti-discrimination law and directors' duties.
The practical first step under both the voluntary guidance and the privacy rule is the same: keep an inventory of your AI systems.
