Is AIDA law in Canada? (October 2026)
Short answer: no. The Artificial Intelligence and Data Act was Part 3 of Bill C-27. The bill died when Parliament was prorogued on 6 January 2025. Its last step had been referral to committee in April 2023 (LEGISinfo C-27). AIDA created no obligations.
What applies to your AI today
| Rule | Who | When |
|---|---|---|
| PIPEDA: consent, purpose, safeguards and accountability for personal information, including when AI uses it | Private sector | In force (OPC) |
| Quebec Law 25, s.12.1: notice and review for decisions made exclusively by automated processing | Enterprises handling Quebec personal information | In force since 22 Sep 2023 (LégisQuébec) |
| OSFI Guideline E-23: model inventory and risk rating, AI/ML included | Federally regulated financial institutions | 1 May 2027 (OSFI) |
| Ontario ESA: say in job postings if AI screens applicants | Ontario employers with 25+ staff | 1 Jan 2026 (Ontario) |
| Directive on Automated Decision-Making: Algorithmic Impact Assessment | Federal departments, and in practice their vendors | Updated 24 Jun 2025 (TBS) |
What is only proposed
Bill C-36 (45th Parliament) would replace part of PIPEDA and add transparency for automated decisions. It was introduced on 15 June 2026 and is not law. Check its stage on LEGISinfo.
Practical first step
Whatever passes later, every regime above starts with knowing which AI systems you run. List them, one line each: owner, purpose, personal information used, whether a person reviews the result.
