Ontario: disclosing AI in job postings (in force 1 January 2026)
Under the Employment Standards Act, 2000, employers with 25 or more employees must say in each publicly advertised job posting whether artificial intelligence is used to screen, assess or select applicants (Ontario ESA guide).
Quick facts
- It applies to external public postings. Read the official guide for the exclusions, such as internal postings and general "help wanted" signs.
- A recruiter or third party posting for you does not remove the duty. Check the guide for details.
Sample wording (adapt it, and keep it true)
"We use artificial intelligence tools to help screen applications for this role. A member of our recruiting team reviews the results."
Only use this wording if it is accurate. If no AI is used, you do not need to say anything.
Keep a record
For each hiring tool, write down: vendor, what it scores, whether a person reviews the result, and the date checked. If you hire in Quebec, also check Law 25 s.12.1 for decisions made exclusively by automated processing.
