Colorado AI Act after SB 26-189: what applies on 1 January 2027

Checked 13 Oct 2026 against the official sources listed below. Plain-English checklist, not legal advice.

Short answer: SB 24-205 was never enforced (a court ruled in April 2026 that it could not yet be enforced), and Colorado enacted SB 26-189 (signed 14 May 2026), which repeals and replaces it with an automated decision-making technology (ADMT) law effective 1 January 2027. It covers ADMT used in consequential decisions such as employment, housing, lending, insurance, health care, education and essential government services. Attorney General rules are due by 1 January 2027.

Checklist for 1 Jan 2027

Enforcement

Enforced by the Attorney General under the Colorado Consumer Protection Act (a violation is a deceptive trade practice). Before 1 January 2030 the AG must give 60 days' notice and a chance to cure where a cure is possible. No new private right of action. The AG must adopt rules on the post-adverse-outcome disclosures by 1 January 2027 (official bill summary).
