Article 25 of the EU AI Act: three ways a deployer turns into a provider (and takes on provider duties)

Last updated 21 Oct 2026 · India

Short answer. Under Article 25(1) of the EU AI Act (Regulation 2024/1689), a deployer, distributor or importer is treated as the provider of a high-risk AI system, with the provider obligations of Article 16, if it: (a) puts its name or trademark on a high-risk system already on the market; (b) makes a substantial modification to a high-risk system that stays high-risk; or (c) changes the intended purpose of an AI system (including a general-purpose one) so that it becomes high-risk. The original provider must then cooperate and hand over the information needed (Article 25(2)).
