Article 26 of the AI Act: what deployers of high-risk AI systems must do

Last updated 25 Oct 2026 · India

Short answer. Article 26 of the AI Act (Regulation (EU) 2024/1689) sets the duties of deployers, the businesses that use a high-risk AI system. They must use it according to the provider's instructions for use, assign human oversight to people with the competence, training and authority to do it, make sure input data they control is relevant, monitor the system and tell the provider and authorities about risks or serious incidents, keep the automatically generated logs for at least six months, and, as employers, inform workers' representatives and affected workers before using a high-risk system at the workplace. People subject to decisions by certain high-risk systems must be told.

Deployer checklist

  1. Confirm the system is high-risk (Article 6 and Annex III) and that you are a deployer, not a provider.
  2. Get the instructions for use from the provider and follow them.
  3. Name the people who oversee it and record their training.
  4. Set up monitoring and a route to report problems to the provider.
  5. Keep logs under your control for at least six months.
  6. Tell staff and their representatives before switching it on at work.

Common mistakes

Application dates: the AI Act sets 2 August 2026 for most high-risk rules (Article 113). In November 2025 the European Commission proposed changes to these dates in its Digital Omnibus package. Check the AI Act Service Desk for the date that applies to your system today.
