EU AI Act Article 5: prohibited AI practices — a plain list for small businesses

Last updated 14 Oct 2026 · European Union

Short answer. From 2 February 2025, Article 5 of the EU AI Act prohibits certain AI practices in the Union — including harmful manipulative or deceptive techniques, exploiting vulnerabilities (age, disability, social/economic situation), social scoring that leads to unfair treatment, untargeted scraping of faces to build recognition databases, emotion inference in workplaces and schools (with narrow exceptions), some biometric categorisation, and most real-time remote biometric identification in public spaces for law enforcement (Article 5 text; timeline on the Commission AI Act page). Additional bans on certain intimate-image and child-abuse material generation/manipulation apply from 2 December 2026. If your SME only uses ordinary productivity chatbots, you are usually outside these bans — but you must still not deploy any of the listed practices.
