Apartment owners association registration in Andhra Pradesh (Vizag, Vijayawada): society checklist, fees and RERA duties
Short answer: in Andhra Pradesh, flat owners usually register their association as a society with the Registrar of Societies under the Andhra Pradesh Societies Registration Act, 2001. IGRS AP lists at least 7 members, an executive committee of at least 3, a memorandum and bye-laws, and a 7-item document checklist. The fee schedule (G.O.Ms.No.475, 25.7.2012) gives Rs.500 for registering a society. The RERA Act also makes the builder enable the association and hand over documents and common areas to it.
What the RERA Act puts on the builder and on you
| Who | What the Act says | Section |
|---|---|---|
| Builder (promoter) | "enable the formation of an association or society or co-operative society ... of the allottees ... under the laws applicable". Where there is no local law, the association "shall be formed within a period of three months of the majority of allottees having booked" their flats. | s.11(4)(e) |
| Builder | Provide and maintain essential services "on reasonable charges, till the taking over of the maintenance of the project by the association of the allottees". | s.11(4)(d) |
| Builder | After the occupancy certificate and handover, give "the necessary documents and plans, including common areas, to the association of the allottees ... as per the local laws"; with no local law, within thirty days of the completion certificate. | s.17(2) |
| You (allottee) | "shall participate towards the formation of an association or society or cooperative society of the allottees". | s.19(9) |

First meeting: an agenda you can copy
A starting template, not an official form. Adapt it to your building and the model bye-laws.
- Record who attended (flat number, name, signature). You need at least 7 adult members to register.
- Resolve to form the association and agree its name (check the name rules below).
- Adopt the memorandum and bye-laws (start from the department's model MOA and bye-laws).
- Elect the executive committee (at least 3 members) and office-bearers.
- Authorise one member to apply to the Registrar of Societies and to collect signatures and photographs.
- List what to ask the builder for: approved plans, occupancy certificate, common-area details, maintenance accounts and deposits, equipment warranties and service contracts.
- Agree a date to take over maintenance, and who keeps the records till then.
Write the minutes the same day. The "proceedings of the first meeting" are on the documents list.
Rules that apply after you register
- Every year, within fifteen days of the general body meeting, send the Registrar the list of managing committee members and officers with addresses.
- The executive committee meets at least once in three months; the general body at least once a year.
- File any amendment and the minutes of meetings with the Registrar.
- Name rules: no name identical or similar to another society in the same district, nothing barred by the Emblems and Names (Prevention of Improper Use) Act, 1950, and words like "co-operative", "union", "State", "Municipal" or "Chartered" need State Government permission.
Is a "society" the right form for a flat owners' group?
The society route is what most of the department's pages describe, and the RERA Act lists "association or society or co-operative society" as options. The department's list of society objects (art, charity, culture, "any public purpose" and so on) doesn't name apartment maintenance in so many words, so ask the District Registrar's office whether your bye-laws' objects will be accepted before you file (to verify). Some buildings use other laws, such as a co-operative society; a lawyer can tell you which suits yours.
