Builder adding floors or changing the plan after booking in Andhra Pradesh: allottee consent under AP-RERA

Official texts read on 27 Oct 2026 · Not legal advice · Government websites change, so re-check before you rely on a step.

Short answer: AP-RERA's FAQ says a builder may make only minor changes to the sanctioned plan on its own. A major change needs approval from two-thirds of the buyers, with the builder's own flats left out and one vote per buyer (FAQ Q68). Extra floors from new FSI are possible only with buyers' consent under section 14 (Q81). Buyers who signed before the project was registered must consent too (Q76).

Who this is for: buyers in Vizag, Vijayawada, Guntur, Tirupati and elsewhere in Andhra Pradesh who are told the builder is adding floors, moving amenities, or changing their flat after booking.

Can the builder change the sanctioned plan?AP-RERA FAQ Q68: only "in case of minor additions or alterations". For "major modification/alteration" only "after having taken approval from two-third of the allottees". The promoter's apartments are excluded from the count, and each allottee has "only ... one vote".FAQ copy saved 15 Oct 2026 (the AP-RERA site did not load on 27 Oct)
Extra floors from additional FSIFAQ Q81: "Yes, but consent of allottees would be needed as mentioned in section 14 of the Act."Same copy
Buyers from before RERA registrationFAQ Q76: "consent of all pre-registration allottees shall be required as well."Same copy
Later phasesFAQ Q75: the plans of later phases can be changed "as per section 14 of the Act".Same copy
What the Act saysRERA Act s.14(2)(i): no change to your apartment without your previous consent, except minor changes, and an "addition to the area or change in height" is never minor. s.14(2)(ii): other changes need the previous written consent of at least two-thirds of the allottees other than the promoter.Read (text of the Act read from our saved copy of 21 Oct 2026; the hosting PDF returned 200 on 27 Oct)
A numbering slip in the FAQFAQ Q69 cites "section 14(2)" for the five-year defect liability. In the Act text we read, that rule is in s.14(3). The substance (five years from possession) is the same.Noted; to verify if you cite it

What to do in AP when the plan changes

  1. Get the old and new plans in writing, with the permission number. Check them with our AP building permission check guide.
  2. Ask: minor or major? Extra floors, a bigger built area or a height change are not minor under the Act.
  3. For a major change, ask to see the two-thirds consent (Q68), and check that pre-registration buyers were included (Q76).
  4. Compare with your agreement for sale (our AP agreement of sale checklist) and with the plans on the AP-RERA project page.
  5. If the builder goes ahead without consent, AP-RERA takes complaints (our AP-RERA complaint guide).

Red flag: "the government gave extra FSI, so no consent is needed". FAQ Q81 says the opposite: consent of allottees is needed under section 14.
