Builder changed the plan or added floors after booking in Hyderabad? Two-thirds consent under RERA section 14
Short answer: once the sanctioned plan has been shown to you, a builder in Telangana cannot change your flat without your previous consent, except minor changes (RERA Act section 14(2)(i)). Any other change to the building or the common areas, such as extra floors, needs the previous written consent of at least two-thirds of the buyers, not counting the builder (section 14(2)(ii)). The Telangana model agreement for sale repeats this: no additions or alterations "without the previous written consent of the Allottee" (clause 1.6). A new approval from GHMC or HMDA does not replace the buyers' consent.
Who this is for: Hyderabad buyers who hear that the builder "got permission for two more floors", that the clubhouse is moving, or that the layout of their own flat is changing after they booked.
What the official texts say
| Question | Source and text | Status |
|---|---|---|
| Must the builder follow the sanctioned plan? | RERA Act s.14(1): the project "shall be developed and completed ... in accordance with the sanctioned plans, layout plans and specifications as approved by the competent authorities". | Read (text of the Act read from our saved copy of 21 Oct 2026; the hosting PDF returned 200 on 27 Oct) |
| Changes to my own flat | s.14(2)(i): no additions or alterations to the apartment "without the previous consent of that person". Minor changes are allowed if you ask for them, or if needed for architectural or structural reasons, recommended by an authorised architect or engineer and intimated to you. | Read (same copy) |
| What is not "minor"? | Explanation to s.14(2)(i): "minor additions or alterations" excludes structural change, "an addition to the area or change in height", removal of part of a building, and cutting into walls, columns, beams or floors, among others. | Read (same copy) |
| Extra floors or common-area changes | s.14(2)(ii): "any other alterations or additions in the sanctioned plans ... of the buildings or the common areas" need "the previous written consent of at least two-thirds of the allottees, other than the promoter". One buyer counts once, however many flats he or his family booked. | Read (same copy) |
| Does the TG agreement say the same? | TG model agreement clause 1.6: the promoter "shall not make any additions and alterations in the sanctioned plans, layout plans and specifications" or the Schedule D and E fixtures "without the previous written consent of the Allottee as per the provisions of the Act". | Read 27 Oct 2026 |
| Does a revised GHMC/HMDA sanction count as consent? | s.14(2) applies "notwithstanding anything contained in any law, contract or agreement". We found no Telangana RERA order on our checked pages on a revised sanction obtained without buyers' consent. | To verify with your lawyer |
| Defects after handover | s.14(3): structural or workmanship defects reported within five years of possession are to be fixed within 30 days at no charge. | Read (same copy) |
Check this if the builder announces a change
- Ask for the change in writing: the old and the new sanctioned plan, and the permission number. Check the approval status with our building permission check guide.
- Compare with the plan in your agreement for sale and its schedules. Anything outside "minor" in s.14(2)(i) needs your previous consent.
- For extra floors or common areas, ask how the two-thirds written consent was collected and how many buyers signed. Do not sign a blank or bundled consent form.
- Check the TG-RERA project page for the plans uploaded there (our TG-RERA project check guide).
- Talk to the other buyers. The two-thirds count is per buyer, not per flat, and the builder's own flats are left out.
- If the change goes ahead without consent, a complaint lies to TG-RERA (our complaint guide).
Red flag: a consent letter handed out with the possession papers, or tucked into a "no objection" for a loan, that also agrees to "future additions". Read every page before you sign.

Can a builder in Hyderabad add floors after I booked?
Only with the previous written consent of at least two-thirds of the allottees, other than the builder (RERA Act s.14(2)(ii)).
Can the builder change my flat's layout?
Not without your previous consent, except minor changes (s.14(2)(i)). An addition to area, a change in height or cutting into walls or columns is not minor.
How is the two-thirds counted?
Per allottee, not per flat. A buyer with several flats, or flats in family names, counts once, and the builder's own flats are excluded.
Is a new GHMC or HMDA approval enough?
Section 14(2) applies notwithstanding any other law or contract. Whether a revised sanction without consent can stand is to verify with your lawyer.
