Can a builder sell car parking separately in Hyderabad? Open, stilt and covered parking under RERA (Telangana)

Official texts read on 26 Oct 2026 · Not legal advice · Government websites change, so re-check before you rely on a step.

Short answer: under the RERA Act a builder in Hyderabad cannot sell you an open parking space as a separate item, because the Act lists "open parking areas" inside the "common areas" that belong to all flat owners together (section 2(n)(iii)). A garage (a space with a roof and walls on three sides, section 2(y)) can be priced and sold. The Telangana RERA model agreement for sale has a separate price line for "Garage/Covered parking". Whether a stilt or basement slot counts as "covered parking" that can be sold, or as a common area, is not settled by any Telangana text we read. Treat it as to verify with your lawyer.

Who this is for: Hyderabad and Telangana flat buyers who see a line such as "car parking Rs 3 lakh" on a cost sheet, or who are told the "parking is extra" at booking.

Check this before you pay for parking in Hyderabad

  1. Ask what kind of slot it is. Open (no roof), stilt (under the building), basement, podium, mechanised, or an enclosed garage. Get the answer in writing, with the slot number marked on the parking plan.
  2. If the cost sheet charges for an open slot, point to s.2(n)(iii) and ask the builder to remove the charge or give the legal basis in writing. Keep the reply.
  3. If it is a covered slot or garage with a price, make sure it appears in the price table of the registered agreement for sale, not only on a booking form or a WhatsApp message. Price, slot number and level should all be in the agreement.
  4. Check the RERA project page. Use our TG-RERA project check guide. Compare the parking details in the approved plan and the promoter's quarterly updates with what you are being sold.
  5. At handover, check that the slot you get matches the one in the agreement. Our possession handover checklist covers this.

Red flag: a parking charge that is paid in cash or into an account other than the project account, or a slot that is "allotted" only on a separate receipt. If there is a dispute, a promise that is not in the registered agreement is hard to prove. Our TG-RERA complaint guide explains Form M.
