Home loan legal opinion and title search report in Andhra Pradesh, Vizag or Vijayawada: what the bank checks and what you still must check
Short answer: before a bank gives a home loan on a flat or plot in Vizag, Vijayawada or anywhere in Andhra Pradesh, it gets a legal opinion on the title from its own approved advocate, and you usually pay the fee. That opinion protects the bank. The AP Registration Department's property purchase FAQ says "Buyer beware is the golden mantra" and "the entire onus lies on the purchaser in verifying the title, ownership and possession of the property". So use the bank's check as a second opinion, not your only one.
What the AP registration department says about title
- "If the seller's title is defective, you will get only defective title."
- The municipal Assessment Register entry (house tax record in the owner's name) is "required for loans, title opinions, electricity meter name change, etc." If it is not in the seller's name, ask for mutation first.
- "Innocent purchasers can be duped by clever vendors by delivering colour Photostat copies instead of original." Ask to see originals.
- On a seller's old loan: "Release certificate issued by the bank is necessary for all the debts over the land. ... if you want to take a loan in future, the release certificate is a must."
- "Engage a competent lawyer ... to investigate the title, possession, ownership and other aspects."

What the bank's lawyer is checking, in the bank's own words
When you take a home loan, the bank asks its own advocate to look at the property papers and give a legal opinion (often called a title search report or legal scrutiny report). One large lender, SBI, says on its home loan FAQ: "The title of the property should be clear, for which a certificate would be required from the Bank's approved advocate, safeguarding your interests as well as Bank's interests." The same FAQ says: "Out of pocket expenses like CERSAI charges and Professional fee for Legal Opinion and Valuation also will be recovered." So the opinion is usually paid for by you. Other banks' rules and fees differ; ask yours.
The bank's check vs your own check
| Question | Bank's legal opinion | What you should still do |
|---|---|---|
| Who is it written for? | The lender, to decide whether it can take a mortgage on the property. | Ask the bank whether it will give you a copy. Whether it must is to verify; we found no rule on it. |
| Registered transactions (sale deeds, mortgages) | The advocate usually reads the encumbrance certificate (EC) and link documents. | Pull the EC yourself too, and ask your own lawyer to read it with the link documents. The AP FAQ says to check the EC from the Sub-Registrar office or MeeSeva centres. |
| Court cases | Depends on the bank's format: to verify with your bank. | Search eCourts yourself by the seller's name. |
| Possession and neighbours | Usually not covered by a desk review. | Visit the site. The AP Registration Department (IGRS) calls personal inspection "the most important precaution". |
| Building approvals | Many lenders ask for the approved plan and occupancy certificate (SBI's list includes them). | Check the permission number on the state portal yourself. |

Your original title deeds while the loan runs, and after
A home loan is usually secured by depositing your original title deeds with the bank. The registration departments warn buyers about this from the other side: when a seller says the originals are missing, "There is a possibility of keeping the original documents in banks/financial institutions/private lenders to create mortgage/charge over the property by way of deposit of title deeds."
When you finish paying, an RBI circular (RBI/2023-24/60, 13 Sep 2023) says lenders "shall release all the original movable / immovable property documents and remove charges registered with any registry within a period of 30 days after full repayment/ settlement of the loan account". If the delay is the lender's fault, "it shall compensate the borrower at the rate of ₹5,000/- for each day of delay". The circular says the timeline and place of return will be in loan sanction letters issued on or after its effective date, and it applies where release falls due on or after 1 December 2023. It is written for "personal loans" as RBI defines them; check with your bank that your home loan is covered, and whether RBI has since moved this into newer directions (to verify).
Do this on day one: keep a photocopy and a list of every original you hand over (sale deed, link deeds, EC, approvals), signed by the branch. Check the sanction letter for the return timeline.
Five questions to ask the loan officer before you pay the seller an advance
- Which advocate will give the legal opinion, and how long does it take?
- What is the fee for the legal opinion and the valuation, and is it refundable if the bank rejects the property?
- Can I get a copy of the legal opinion or title search report? (to verify per bank)
- Which documents must be originals, and which period of EC do you need? (banks set this themselves; to verify)
- Where and within how many days will my originals be returned when I close the loan?
Ask these early. If the bank's advocate rejects the title after you have paid an advance, you may be left arguing with the seller over the refund. Put a clause in the agreement of sale about what happens if the loan is not sanctioned (ask your own lawyer for the wording).

What does a bank check before a home loan in Vizag or Vijayawada?
Its approved advocate reviews the title papers and gives a legal opinion. Lenders also ask for documents such as the sale deed, EC, approved plan and occupancy certificate; the exact list depends on the bank.
Who pays for the bank's legal opinion?
Usually the borrower. SBI's home loan FAQ says the professional fee for legal opinion and valuation is recovered as an out-of-pocket expense. Ask your bank for its fee.
Can I rely only on the bank's title search report?
It is written for the bank. The registration department still advises engaging your own lawyer and says an EC alone is not enough to buy or lend.
When must the bank return my original documents after closing the loan?
An RBI circular of 13 Sep 2023 says within 30 days of full repayment, with ₹5,000 per day compensation if the delay is the lender's fault. Check that your loan is covered and the current RBI direction.
What does 'buyer beware' mean in AP property purchase?
The AP Registration Department's FAQ says the entire onus lies on the purchaser to verify title, ownership and possession, so do your own checks as well as the bank's.
