Home loan closed in Andhra Pradesh (Vizag, Vijayawada): re-conveyance and release of title deeds charges
Short answer: In Andhra Pradesh, a re-conveyance of mortgaged property after a loan is repaid is listed at Rs 50 stamp duty, Rs 500 registration fee and Rs 200 user charges (IGRS duty and fee table, row 48). A release of a deposit of title deeds is listed at Re 1 revenue stamp, Rs 1,000 fee and Rs 100 user charges (row 50).
The rows, as published
- Row 48, Reconveyance of mortgaged property: stamp duty Rs 50; registration fee Rs 500; user charges Rs 200.
- Row 50, Release of Deposit of Title Deeds: stamp duty Re 1 (revenue stamp); registration fee Rs 1,000; user charges Rs 100.
- Row 49 is a different document: release of a right of redemption of a mortgage with possession, or of a right to obtain re-conveyance, is Rs 1,000 duty, a 0.5% fee (minimum Rs 1,000, maximum Rs 10,000) and Rs 100 user charges. It is not the usual home loan closure paper, so check which row the office applies.
- Stamp schedule, Article 45: a re-conveyance pays the same duty as a conveyance only if the mortgage was for Rs 1,000 or less; "in any other case", fifty rupees.
Who pays the stamp: section 29 of the Stamp Act on the AP IGRS site says that, unless agreed otherwise, the stamp on a conveyance "including a reconveyance of mortgaged property" is borne by the grantee, which on a re-conveyance is the borrower.
How it adds up
Example only, not a quote: from rows 48 and 50; stamp vendor charges and rounding are extra or to verify.
- Re-conveyance deed after a Rs 40,00,000 loan: Rs 50 + Rs 500 + Rs 200 = Rs 750.
- Release of deposit of title deeds after a Rs 40,00,000 loan: Re 1 + Rs 1,000 + Rs 100 = Rs 1,101.
- When you took the loan: the deposit of title deeds itself was charged on the amount secured (AP home loan mortgage guide). Closing it is a fixed small amount.
Three things to ask before you close the loan
- Which document: a re-conveyance (row 48) or a release of deposit of title deeds (row 50)? It depends on how the mortgage was made. Ask the bank.
- Is registration needed: whether a no-dues letter and the return of your deeds are enough, or a registered release is needed for the EC to show the charge closed, is not stated in what we read (to verify).
- Current figures: run the IGRS Duty Fee Calculator before the bank's officer comes to sign.
Whether your bank must give you a registered release, and what your loan papers say, are questions for your bank and your own lawyer. This page only lists the published fee and duty rows. Not legal advice.
