Waqf and endowment (temple) land check before buying property in Telangana and Hyderabad
Short answer: waqf land and temple (endowment) land are two separate categories, and both can sit inside survey numbers that look like ordinary patta or layout land. A transfer of waqf property is void under section 51(1A) of the Waqf Act, so a buyer cannot cure it later with a registration. In Telangana, run three checks before paying: the Registration department's Prohibited Properties page (on 23 Oct 2026 it said "Prohibition data is under review. it will be published soon..."), the land class on Bhu Bharati, and a written enquiry with the Telangana State Waqf Board and the Endowments Department for the exact survey number.
Situation and what to do (Telangana)
| What you find | What it can mean | What to do before paying |
|---|---|---|
| A mosque, dargah, ashurkhana or graveyard on or next to the plot | Possible waqf land, including waqf by long use. | Ask the Waqf Board in writing about the survey number; do not rely on the seller's word. |
| A temple nearby, or "inam" / "devadayam" / "maanyam" in old revenue papers | Possible endowment (temple) land or a service inam. | Ask the Endowments Department whether the survey number is in its asset register (to verify how the register is searched). |
| Bhu Bharati or the passbook shows a land class other than private patta | Under s.9 of the Bhu Bharati Act 2025, Endowment or Wakf land may get Bhudhaar numbers "from specially reserved series". | Ask the seller for the Bhudhaar and land class; treat a reserved-series number as a stop sign until explained in writing. |
| The survey number is on a prohibited list | Registration may be refused. | Bhu Bharati FAQ Q19: the owner applies under "Grievance relating to prohibited properties list" for removal. The seller does this, before you pay. |
| A newspaper notice about waqf mutation for the village or ward | A claim is being recorded. | Pause. Get a lawyer to read the notice and file objections in time if you already hold an agreement. |
| A "lease" or "GPA" from a mutawalli or committee | Section 51(1): a waqf lease is void without the Board's prior sanction. | Ask for the Board's sanction order; without it, do not pay. |
Why waqf land is different from an ordinary title problem
Section 51(1A) of the Waqf Act, now titled the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995, says: "Any sale, gift, exchange, mortgage or transfer of waqf property shall be void ab initio". Section 51(1) adds that a lease of waqf property "shall be void unless such lease is effected with the prior sanction of the Board", and that no mosque, dargah, khanqah, graveyard or imambara shall be leased. Section 52 deals with recovery of waqf property transferred in breach of section 51. In plain words, if a plot really is waqf property, a registered sale deed in your name may not give you title, however clean the rest of the papers look.
What changed in 2025 (and what is still open)
| Change | What the official document says | Why a buyer cares |
|---|---|---|
| In force date and new name | The Waqf (Amendment) Act, 2025 came into force on 08.04.2025 (Lok Sabha answer, 11.02.2026). The 1995 Act is renamed the Unified Waqf Management, Empowerment, Efficiency and Development Act (Rajya Sabha answer, 11.08.2025). | Notices and orders after April 2025 may cite the new name; it is the same Act. |
| Central portal | The UMEED Central Portal was launched on 06.06.2025; registration applications are made through it and forwarded to the District Collector for inquiry (RS answer). Existing waqf details were due on the portal within six months, a period that ended on 06.12.2025, with the Waqf Tribunal able to extend it by up to six months (LS answer). | The portal is meant to become the place where waqf claims are listed. We could not open it on 23 Oct 2026, so public search access is to verify. |
| Board's own declaration | Section 40, the Board's power to decide whether a property is waqf, is omitted (RS answer). | Older notices issued under section 40 may still matter; ask your lawyer. |
| Deed and lawful owner | Only a lawful owner can create a waqf, and a waqf deed is mandatory for new registration (RS answer). | Ask whether any claim on the plot rests on a deed, on long religious use, or on a survey entry. |
| Government land, disputes | The Bill as passed by Lok Sabha says government property identified as waqf "shall not be deemed to be a waqf property" (s.3C), and waqf by user stays waqf except where the property "is in dispute or is a government property" (proviso to s.3(r)) (Bill text, 3.4.2025). | Mixed government / waqf / private claims are now decided through a Collector-level inquiry. Expect delay. |
| Mutation notice | Revenue authorities must give 90 days' public notice in two daily newspapers, one in the regional language, before deciding mutation (s.5(3) and s.37(3) in the Bill text). | Watch the local newspaper notices for the village or ward before you pay. |
| Limitation and appeal | The Limitation Act, 1963 applies to waqf property claims (s.107 in the Bill text); a Tribunal order can be appealed to the High Court within 90 days (s.83(9)). | Old possession may now count, but only a court or Tribunal decides that. |
Seven waqf and endowment checks before you buy in Telangana
- Get the full description: survey number, sub-division, village, mandal, Bhudhaar and land class from the seller's passbook or ROR-1B, and the door number for a city property.
- Look at the ground: note any mosque, dargah, graveyard, ashurkhana or temple on or beside the land, and ask neighbours about old religious use.
- Read the old papers: ask for link documents and old revenue entries going back as far as possible. Words like inam, wakf or devasthanam in any of them need an explanation.
- Check the prohibited list: use the prohibited property check. If the data is still "under review", keep a dated screenshot and do not treat a blank result as clearance.
- Write to the authorities: send a written enquiry with the survey number to the Telangana State Waqf Board and the Endowments Department, and keep the reply with your file.
- Watch for notices: under the 2025 amendment, mutation of waqf property needs a 90-day newspaper notice (Bill text). Search recent local papers for the village name.
- Put it in the agreement: have your lawyer add a seller declaration that the land is not waqf or endowment land, with refund of advance if a claim appears before registration.
Common mistake: treating a clean encumbrance certificate as proof. An EC shows registered transactions; a waqf or endowment claim may come from a gazette list, a survey or long religious use that never appears in an EC.

Not legal advice. This page summarises official documents read on 23 Oct 2026. Whether a particular plot is waqf or endowment land is decided by the authorities, Tribunals and courts, not by a website. Have a lawyer check the title, and re-check each step because rules and court orders change.
