NRI power of attorney in Telangana (Hyderabad): GPA and SPA stamp duty, registration fee and signing abroad
Short answer: The Telangana Registration & Stamps Department's registration fee notification (in force from 02-09-2021) lists 0.5% for a power of attorney to sell, construct, develop or transfer property: minimum Rs 2,000 and maximum Rs 20,000 if it's given to a family member, minimum Rs 5,000 and maximum Rs 1,00,000 if it's given to anyone else. A GPA for purposes other than selling property is Rs 5,000, and authenticating a Special Power of Attorney (SPA) is Rs 3,000. Stamp duty is separate: the department's Stamps FAQ (Q8) gives 1% of the property value for a POA to someone outside the family as an example, "subject to change from time to time".
Registration fee for a power of attorney (notification of 02-09-2021)
- POA to sell, construct, develop or transfer immovable property, given to a family member: 0.5%, minimum Rs 2,000, maximum Rs 20,000.
- Same POA given to a person other than a family member: 0.5%, minimum Rs 5,000, maximum Rs 1,00,000.
- Power of attorney for consideration: 0.5%, minimum Rs 5,000, maximum Rs 1,00,000.
- General Power of Attorney other than sale of immovable property (for example managing property or loans): Rs 5,000.
- Authentication of a Special Power of Attorney: Rs 3,000.
- Agreement of sale cum GPA: 0.5%, minimum Rs 5,000, maximum Rs 1,00,000; development agreement cum GPA: same.
- The same table lists Rs 2,000 for "Rectification / Ratification / Cancellation of any Deed". Whether that's the fee to cancel a registered POA is for the SRO to confirm (to verify).
- "Family member" in that table means father, mother, husband, wife, brother, sister, son, daughter, grandfather, grandmother, grandchild, adoptive father or mother, and adopted son or daughter.
Stamp duty on a power of attorney
- POA to someone outside the family: the Stamps FAQ (Q8) uses this as its example: 1% stamp duty on the value of the property, after deducting any stamp duty already paid in another state, "subject to change from time to time".
- Sale agreement cum GPA: 6.5% (5.5% adjustable, 1% not adjustable); development agreement cum GPA: 1%, not adjustable, per G.O.Ms.No.59 (20-07-2021, from 22-07-2021).
- POA to a family member: its stamp duty isn't in G.O.Ms.No.59 or the FAQ we read (to verify). Ask the SRO before you sign.
- Who pays: the Stamps FAQ (Q12) says, unless agreed otherwise, the executing party pays the stamp duty on a power of attorney. If you're unsure of the duty, Q13 says you can apply to the District Registrar under Section 31 of the Indian Stamp Act with the draft deed, an affidavit and a fee of Rs 15.
NRIs: signing abroad
The Stamps FAQ (Q7) says stamp duty on a document executed out of India, to be used in Telangana, can be paid within three months from the date it is received in India, before the District Registrar, who endorses the payment under Section 18 of the Indian Stamp Act. Don't let the three months lapse.
The department's model "Attestation of Special Power of Attorney" is written for sellers living abroad who have signed a sale deed and appoint someone to present it at the SRO. Its instructions to the executant say:
- Sign each and every page of the sale deed, the SPA and the photo form with a black ink pen.
- Put the left thumb impression in black ink on the photo form and affix a passport size photograph.
- Send an ID cum address proof from the country you live in (the model says USA).
- Have each page of the sale deed and SPA attested by a Notary Public with seal and signature.
- Two witnesses abroad sign the SPA, not the sale deed.
Whether your SRO also needs embassy or consulate attestation, or anything else, is (to verify); it isn't in the model.
The department's model POA forms
The department's website links model forms under Downloads: GPA (without sale), which is drafted for a principal "away from India" appointing a father to manage property, loans and court matters; GPA in favour of family members to sell; and GPA in favour of other than family members to sell. When we downloaded them on 14 Oct 2026, the "family members" link gave the same text as the "other than family" form (both headed "in favour of other than family member"), so check the wording with your lawyer. The model to-sell GPA includes a clause that the POA "is supported by consideration and hence is not revocable except through a decree of a Civil Court". Read every clause before you sign; the department's own disclaimer says it "owns no responsibility for the clauses" and each document is unique.
Why buyers should care: forged NRI POAs
The department's Property Transaction Advisory tells buyers to enquire thoroughly about the bona fides of a power of attorney and agent, and warns: "There are several cases of forged power of attorneys including fabricated powers as if given by NRI principals." It also asks buyers to verify the EC and copies of documents (CC), and to check impersonation.
What it means for you
- Green: the seller signs in person, or the POA is registered, its document number shows up in the EC, its scope covers this exact property and sale, and you've spoken to the principal directly.
- Amber: the POA was signed abroad and is still within the three-month stamp duty window, or it's an SPA to present a deed only. Ask your lawyer what it allows before you pay.
- Red: an unregistered or photocopied POA, a holder who won't let you speak to the NRI owner, a POA that doesn't name the property, or pressure to pay the holder's personal account. Don't pay.
Before you sign or rely on a POA: 6 checks
- Get the full fee and duty from the SRO for your exact case (family or not, to sell or not).
- Run the EC and prohibited property check for the property.
- Check the land record on Bhu Bharati.
- Read the POA's schedule: survey number, plot or flat number and boundaries must match the sale papers.
- See our Telangana stamp duty and registration charges page for the sale deed itself.
- Have a lawyer confirm the POA and the title before any payment.
We don't draft POAs or offer a registration service. This page shows what the official Telangana documents say, as we read them on 14 Oct 2026. Both rate documents are scanned PDFs; newer orders may exist (to verify). Property in Andhra Pradesh? See our AP power of attorney page.
