Stamp duty refund in Andhra Pradesh (Vizag, Vijayawada): unused challan, e-stamp and cancelled sales
Short answer: In Andhra Pradesh, stamp duty paid by challan and not used can be refunded if you claim within six months; 10% of the duty is deducted. You apply through the Sub-Registrar to the District Collector, Sub-Collector, Deputy Collector, RDO or Tahsildar, with the original challan and bank receipt (IGRS refund procedure).
The published procedure
- Challan use: a paid challan can be used "at any time", but a refund claim has a limit of 6 months.
- Deduction: the refund is made "after deducting 10% of the total Stamp Duty Paid".
- Where to apply: to the District Collector, Sub-Collector, Deputy Collector, RDO or Tahsildar under section 2(9) of the Stamp Act, through the Sub-Registrar, stating the reason.
- What to attach: the challan and the receipt in original from the designated bank branch.
- What the Sub-Registrar does: checks the bank scroll and records, certifies that the challan is genuine and unused, and the refund follows on that certificate.
Stamp paper and e-stamps
- Stamp paper: the Stamp Duty FAQ (Q19) says the Act allows refund of stamp papers not used or spoiled, but AP sells non-judicial stamp paper only up to Rs 100, so large amounts are paid by challan or e-stamp instead.
- Signed but failed deals: the Stamp Act sections 49 and 50 cover instruments that were void, could not be completed because a party died or refused, or were replaced, mostly within six months, and within two months where someone refused to act or advance money.
- E-stamp certificate: the e-Stamp FAQ says that to cancel one, you contact the Competent Authority at the Stamp Office appointed by the State Government. Whether the same 6 months and 10% apply is to verify.
How it adds up
Example only, not a quote: from the 10% deduction in the IGRS procedure; registration fee and user charges are not covered by it.
- Rs 3,00,000 of duty paid by challan, deal cancelled, claim in 3 months: deduction Rs 30,000, refund Rs 2,70,000.
- Same challan, claim after 7 months: outside the 6-month limit in the procedure; you may still be able to use the challan for a later deal, since it can be used at any time.
Whether your case fits one of these clauses, and whether a deal that fell through can still be revived, are questions for the Collector's office and your own lawyer. This page only lists what the published Act and FAQ say. Not legal advice.
Checklist when an AP property deal is cancelled
- Keep the original challan and bank receipt safe; do not hand them to the other side
- Note the challan date and apply well inside 6 months
- Write the reason in one paragraph, with proof that the challan was never used
- If the sale was already registered, a refund is not the route; see the AP cancellation deed guide
- Paid by e-stamp? Ask the office which authority handles it (AP e-stamp guide)
