Rectification deed and cancellation deed in Andhra Pradesh (Vizag, Vijayawada): stamp duty and registration fee
Short answer: In Andhra Pradesh, the IGRS duty and fee table lists a rectification deed at Nil stamp duty, a cancellation deed at Rs 30, and ratification or other supplemental deeds at Rs 5. Each carries a Rs 1,000 registration fee and Rs 100 user charges. Cancelling or revoking a settlement is listed separately at Rs 90 duty.
The rows in the IGRS table
- Row 56, Rectification: duty Nil, fee Rs 1,000, user charges Rs 100.
- Row 15, Cancellation Deed: duty Rs 30, fee Rs 1,000, user charges Rs 100. The schedule's Article 15 reads "Thirty rupees" for an instrument by which any earlier instrument is cancelled, if attested and not otherwise provided for.
- Row 55, Ratification and other supplemental deeds (section 4): duty Rs 5, fee Rs 1,000, user charges Rs 100. Section 4 of the Stamp Act covers the smaller papers used to complete one sale, mortgage or settlement.
- Row 51, Cancellation / Revocation of settlement: duty Rs 90, fee Rs 1,000, user charges Rs 100.
- Fee table (G.O.Ms.No.463, Category 3, row 3, "Rectification / Ratification / Cancellation of any Deed"): Rs 1,000, the same as the home table.
These rows are for the document types named. If your "correction" changes the extent, price, party or property, ask the Sub-Registrar how it will be charged before anyone signs (to verify).
How it adds up
Example only, not a quote: totals from the table rows above, before stamp paper vendor or e-stamp service charges.
- Rectification of a wrong survey number in a registered sale deed: Nil + Rs 1,000 + Rs 100 = Rs 1,100.
- Cancellation of an earlier power of attorney or agreement: Rs 30 + Rs 1,000 + Rs 100 = Rs 1,130.
- Revoking a settlement: Rs 90 + Rs 1,000 + Rs 100 = Rs 1,190.
Run the IGRS Duty Fee Calculator for your own document before you pay. A sale deed is 4% duty in AP (see our AP sale and gift deed charges guide), so a careful first draft is worth far more than the cost of fixing it.
What the AP department's FAQs add
- Minor's property: if a minor's property was sold without court permission, the sale can be voidable; after coming of age, the sale "has to be perfected by obtaining a registered ratification deed by the person who was a minor at the time of sale" (Property Purchase FAQ).
- Wills: a will can be cancelled any time in the testator's lifetime, and a change to a registered will is a codicil with no stamp duty (Registration FAQ Q11, Q12). See the AP will registration guide.
- Power of attorney: a GPA ends on the death of the person who gave it, and they can cancel it at any time (Q35). See the AP POA guide.
Whether your mistake can be fixed by a rectification deed, whether an earlier deed can be cancelled, and who has to sign, are legal questions for your own lawyer. This page only lists the published fee and duty rows and what the department's own papers say. Not legal advice.
