Rectification deed and cancellation deed in Telangana (Hyderabad): stamp duty and registration fee
Short answer: Telangana's registration fee table of 02-09-2021 charges a flat Rs 2,000 to register a rectification, ratification or cancellation of any deed (Category 3, row 1). The fee doesn't change with the property value. The stamp duty revision G.O.Ms.No.59 of 20-07-2021 has no row for these deeds, so the stamp duty is to verify with the Sub-Registrar office before you buy stamp paper.
Three deeds that are often confused
- Rectification deed: corrects a mistake in a deed that is already registered, for example a wrong survey or plot number, a misspelt name or a boundary written wrongly.
- Ratification deed: a person confirms an earlier deed. The AP department's property purchase FAQ gives one case: a sale of a minor's property is made complete by a registered ratification deed signed by that person after they come of age.
- Cancellation deed: cancels an earlier registered instrument, such as a power of attorney or an agreement.
All three share one Telangana fee row. If the change is more than a correction (a different extent, price, party or property), ask the Sub-Registrar how the document will be charged before anyone signs (to verify).
The rows we found
- Registration fee (fee table of 02-09-2021, Category 3, row 1, "Rectification / Ratification / Cancellation of any Deed"): Rs 2,000.
- Stamp duty: not listed in G.O.Ms.No.59. The Telangana Stamp Act copy (section 4) says that when several papers complete one sale, mortgage or settlement, only the main one pays full duty and each of the others pays a small fixed duty. Ask the office whether that applies to your correction, or which article it will use (to verify).
- Not in the fee table: user or service charges. Ask the office for the full total.
How it adds up
Example only, not a quote: a registered sale deed has one digit of the survey number wrong, and the buyer and seller sign a rectification deed in Hyderabad.
- Registration fee: Rs 2,000, the same for a Rs 20 lakh flat or a Rs 2 crore villa.
- Stamp duty and charges: ask the Sub-Registrar office. We don't show a number because no official row we hold gives one.
Compare: an exchange deed is 5% duty and a sale is 5.5% (see our Telangana sale and gift deed charges guide), so getting the first deed right matters far more than the cost of fixing it.
What the department's papers add
- Get it right the first time: the department's model document forms warn that mistakes in a document "may lead for rectification of mistakes by executing a rectification deed subsequently", and advise care to avoid extra trips to the office (instruction 7).
- Wills: a testator can cancel a will any time in their lifetime. A change to a registered will is a codicil, which the Registration FAQ says needs no stamp duty (Q11, Q12). See the Telangana will registration guide.
- Power of attorney: a GPA ends on the death of the person who gave it, and they can cancel it at any time. A GPA given for consideration can't be cancelled by one side alone to the agent's harm (Q34, Q35). See the Telangana POA guide.
- Not sure of the duty: you can ask the District Registrar for an opinion under section 31 with the draft deed, an affidavit on Rs 20 stamp paper and a Rs 15 fee (Stamps FAQ Q13).
Whether your mistake can be fixed by a rectification deed, whether an earlier deed can be cancelled, and who has to sign, are legal questions for your own lawyer. This page only lists the published fee and duty rows and what the department's own papers say. Not legal advice.
