Stamp duty refund in Hyderabad, Telangana: unused or spoiled stamp paper and cancelled sales
Short answer: In Telangana, the Indian Stamp Act as in force in the state lets the Collector refund stamps that were spoiled, never used, or used on a deal that failed. The refund is the stamp value less ten paise for each rupee (10%), and in most cases you must apply within six months (sections 49 to 54). The Stamps FAQ adds that a G.O. allows refund of duty paid by challan; its terms are to verify.
When a refund is allowed (section 49)
- Before anyone signs: the stamp paper was spoiled by a writing error, or the document was typed out but never signed by any party.
- After signing, but the deal failed: the instrument turned out void from the start, unfit because of a mistake, could not be completed because a party died or refused to sign, failed because someone refused to act or to advance the money, or was replaced by another instrument between the same parties carrying a stamp of not less value.
- Condition for signed papers: no court case has begun in which the document could be used as evidence, and you give the original up to be cancelled.
- Stamps you simply no longer need (section 54): the Collector repays them if you bought them in good faith to use, paid full price, and bought them within the six months before you hand them in.
Time limits (section 50)
- Unsigned stamp paper: within six months after it was spoiled.
- Signed document: within six months of the date of the instrument, or of first signing if it is undated.
- Refusal to act or to advance money (clause (d)(5)): within two months of the date of the instrument.
- Papers sent abroad, for example to an NRI to sign: within six months after they come back to India.
How much comes back (section 53 and 54): the Collector may give other stamps of the same value, or money "deducting ten naye paise for each rupee". The FAQ also says there is no time limit to use stamp paper you bought, so a refund is not your only option (Q20).
How it adds up
Example only, not a quote: from the 10% deduction in sections 53 and 54; whether your case qualifies is for the Collector.
- Rs 4,50,000 of duty paid for a sale that fell through, claim in time: deduction Rs 45,000, refund Rs 4,05,000.
- Rs 1,000 of stamp paper spoiled by a typing error: refund Rs 900, or replacement stamps of Rs 1,000 at the Collector's choice.
- Claim after the time limit: the Act gives no allowance; ask the office before assuming anything.
What to keep before you apply
- The original stamp paper, e-stamp certificate or challan and bank receipt, unsigned or with every signed copy
- A short written reason that matches one clause above, with proof (for example the seller's refusal or the bank's loan rejection)
- The date of the instrument and the date of purchase, so you can show you are inside the time limit
Whether your case fits one of these clauses, and whether a deal that fell through can still be revived, are questions for the Collector's office and your own lawyer. This page only lists what the published Act and FAQ say. Not legal advice.
