Agency (Scheduled Area) land in Telangana: can a non-tribal buy? 1/70 rule check near Bhadrachalam
Short answer: if the land is in a notified Scheduled Area (agency area) of Telangana, such as parts of Bhadradri Kothagudem around Bhadrachalam, a non-tribal generally cannot buy it. The A.P. Scheduled Areas Land Transfer Regulation, 1959, as amended in 1970 (the "1/70" rule), makes a transfer by a tribal to a non-tribal void, presumes that land held by a non-tribal came from a tribal, and lets officials order eviction. A registered deed does not cure this. Before you pay, confirm whether the village is in a Scheduled Area.
Who this is for: Hyderabad buyers and NRIs offered "cheap farm land" or a weekend plot near Bhadrachalam, Kothagudem, Mulugu, Utnoor or other forest-belt villages, and anyone whose seller is not a tribal but holds land in an agency village.
What the Regulation and official pages say (Telangana)
| Point | Source and what it says | Status |
|---|---|---|
| Where the rule applies | A.P. Scheduled Areas Land Transfer Regulation, 1959 s.2(a): "Agency tracts" are areas declared Scheduled Areas by the President under the Fifth Schedule to the Constitution. The Regulation's title names the old Adilabad, Warangal, Khammam and Mahabubnagar districts for the Telangana side. | Regulation text read 24 Oct 2026 (unofficial copy); your village: to verify |
| The core bar | s.3(1)(a), as substituted by Regulation 1 of 1970 (hence "1/70"): any transfer of immovable property in agency tracts by a Scheduled Tribe member is absolutely null and void unless it is to another ST member or an ST-only co-operative society. | Read 24 Oct 2026 (unofficial copy) |
| Non-tribal in possession | s.3(1)(b): until the contrary is proved, land in agency tracts held by a non-tribal is presumed to have come from a tribal. So a non-tribal seller must be able to show how the land came to them lawfully. | Read 24 Oct 2026 (unofficial copy) |
| What counts as a "transfer" | s.2(g) and s.3(4): sale, gift, exchange, lease, mortgage, any other dealing or a contract about the land, a court-decree sale, and a benami deal through a tribal for a non-tribal. Partition and inheritance are not "transfers". | Read 24 Oct 2026 (unofficial copy) |
| Registration | s.3-B: no transfer document for agency-tract property is to be registered unless a declaration by the buyer, in the prescribed form and subject to verification, says the buyer is an ST member or an ST-only society. | Read 24 Oct 2026; the form: to verify |
| Consequences | s.3(2): the Agent or prescribed officer can order ejectment and restore the land to the tribal seller or heirs, even on their own motion. s.6-A: acquiring land against the Regulation, or staying on after an ejectment decree, is punishable with up to one year's rigorous imprisonment, a fine up to Rs 2,000, or both. The Supreme Court in Samatha (1997) held that a non-tribal transferee in agency tracts gets no right, title or interest. | Read 24 Oct 2026 (Samatha via search copy) |
| Who enforces it in Telangana | ITDA Bhadrachalam, Tribal Welfare Department, Government of Telangana publishes "Implementation of LTR in the Scheduled areas of Telangana during 2022-23": 566 cases covering 2,529.29 acres were on its books that year, with 501 still pending at the end. Appeals are heard by the Additional Agent to Government, Bhadrachalam. | Page read 24 Oct 2026 (HTTP 200) |

Five checks before you buy land in a Telangana agency area
- Ask the Tahsildar or ITDA in writing whether the village and survey number fall in a Scheduled Area. Do not rely on the broker's word or on the land being near a town.
- Trace the title back in the Bhu Bharati record and the EC. If any owner in the chain was a tribal and a later owner is not, treat the land as high risk.
- Check the prohibited list on our prohibited property page, and look for an LTR or court case on the land.
- Be wary of workarounds: a deal through a tribal "front" buyer is a benami transfer under s.3(4), and long leases or agreements also count as transfers under s.2(g).
- Get a lawyer's written opinion on the specific survey number before any advance. Land assigned by the government has its own bar; see our assigned land page.
Common mistake: believing that a registered sale deed, a pattadar passbook or decades of possession make the purchase safe. Under s.3(1)(b) the non-tribal holder must prove the land did not come from a tribal, and an ejectment order can follow even years later.

This page summarises the Regulation text (an unofficial copy), official department pages and one Supreme Court judgment read on 24 Oct 2026, with unconfirmed items marked "to verify". Can a non-tribal buy land in Bhadrachalam agency area?
Generally no, where the land is in a notified Scheduled Area. Under s.3(1)(a) of the 1959 Regulation (as amended in 1970), a transfer by a tribal to a non-tribal is void, and s.3(1)(b) presumes land held by a non-tribal there came from a tribal.
What is the 1/70 Act in Telangana?
It is the common name for Regulation 1 of 1970, which substituted section 3 of the A.P. Scheduled Areas Land Transfer Regulation, 1959. Telangana's Tribal Welfare Department (ITDA Bhadrachalam) reports LTR cases under it.
The seller is not a tribal and has a registered deed. Is that enough?
Not by itself. The law presumes the land came from a tribal unless proved otherwise, so trace the full chain and get the Scheduled Area status in writing.
Can I take the land on a long lease instead?
A lease is a transfer under s.2(g). A lease by a tribal to a non-tribal in agency tracts falls under the same bar.
What happens if I buy anyway?
Officials can order ejectment and restore the land (s.3(2)), and s.6-A provides up to one year's rigorous imprisonment, a fine up to Rs 2,000, or both.
