Buying property owned by a minor or with a minor's share in Hyderabad: court permission and ratification

Official pages read on 24 Oct 2026 · Not legal advice · Government websites change, so re-check before you rely on a step.

Short answer: if any part of the flat, house or plot you want in Hyderabad belongs to a child under 18, the parent cannot simply sign it away. The Telangana Registration and Stamps Department's Property Purchase - Precautions page (read 24 Oct 2026) says: "prior approval of the court is required to enable the minor's other/natural guardian to sell the property. In the absence of such permission, the sale could be voidable at the option of the minor on attaining majority." The alternative it names is a registered ratification deed signed by that person after they turn 18. So ask early: is any owner or heir a minor, and is there a court order allowing this sale?

Who this is for: buyers of inherited property in Hyderabad, Ranga Reddy and Medchal where the father has died and the widow sells "for the family", or where a child was made a co-owner by gift or partition. These deals look clean on the EC and still carry a risk that can surface years later.

Buyer: five checks before you pay an advance in Hyderabad

  1. Build the owner list. For inherited property, the TG page says title comes from "Entries in revenue records, and predecessor's title". Ask for the death certificate and a family member certificate, and note every heir's date of birth.
  2. If an heir is under 18, ask for the court order granting the guardian permission to sell. Check that it names this property, this guardian, and (if stated) the price or conditions. A lawyer should read it.
  3. Read the earlier deeds for the word "minor". If a previous sale in the chain was signed for a child, check whether a court order or a later ratification deed exists. Apply for a copy of the registered document (CC) of each link deed.
  4. Ask the neighbours, as the department suggests, about joint owners of the property or part of it, and place a public notice in newspapers before you finalise.
  5. Make the court order a condition in your agreement of sale: no balance payment until the permission is granted, and pay the minor's share as the court directs (to verify: some orders say how the money must be held).

Common mistake: accepting a sale deed where the mother signs "for self and as guardian of my minor son" with no court order, because the Sub-Registrar registered it. Registration does not cure the defect: under s.8(3) the child can still challenge the sale after turning 18. If you are already in this position, ask a lawyer about a ratification deed once the child is an adult.

It does not say how long a minor has to challenge a sale; ask a lawyer. Courts and the Registration Department have the final word. Have a property lawyer read the court order and the title chain before you pay.

FAQ

Can a mother sell her minor child's share of a flat in Hyderabad?

Only with the court's previous permission. The Telangana Registration Department's precautions page and section 8(2) of the Hindu Minority and Guardianship Act both say so. Without it, the child can challenge the sale after turning 18.

Is a sale without court permission void?

Not automatically. Section 8(3) says it is voidable at the instance of the minor or anyone claiming under him, so it stands until the child, as an adult, challenges it. That uncertainty is the buyer's risk.

What is a ratification deed?

A registered deed signed by the former minor after turning 18 confirming the earlier sale. The Telangana precautions page names it as the way to perfect such a sale. Its Telangana stamp duty was not read today (to verify).

Which court gives permission in Hyderabad?

Section 8(6) says the city civil court or district court where the property is located. Which one covers your location is a question for a lawyer (to verify).

Does the EC show that a minor is involved?

An EC lists registered documents, not the owners' ages. Read the deeds themselves for words like 'minor' or 'guardian', and ask for every heir's date of birth.
