Buying gifted property in Hyderabad: can the gift deed be cancelled? Senior citizen and revocation checks

Official texts read on 24 Oct 2026 · Not legal advice · Government websites change, so re-check before you rely on a step.

Short answer: a registered gift deed usually cannot be taken back. Under section 126 of the Transfer of Property Act, a gift can be revoked only on a condition both sides agreed in the deed (not depending on the donor's wish alone) or on grounds like fraud. The bigger risk for a Hyderabad buyer is section 23 of the Senior Citizens Act, 2007: if a parent gifted the flat or plot on condition of being looked after, and that care stops, the Maintenance Tribunal can declare the gift void. So if your seller got the property by gift, read the gift deed, check whether the donor is alive, and ask whether any tribunal or court case exists before paying.

Who this is for: buyers in Hyderabad, Ranga Reddy and Medchal whose seller says "my father gifted it to me" or "my mother gave it by gift deed", and NRIs buying such a flat through a relative.

Buyer: five checks before you buy gifted property in Hyderabad

  1. Get the gift deed itself, not just the seller's word. Apply for a copy of the registered document (CC) and read every condition: care, maintenance, residence for the donor, or any revocation clause.
  2. Check the donor. Is the donor alive? Over 60? If yes, and the deed has a care condition, treat it as a real risk and ask a lawyer. If a condition depends only on the donor's wish, s.126 makes such a gift void, which is a title problem too.
  3. Pull an EC after the gift date and look for a cancellation or rectification deed. See our page on cancellation deeds.
  4. Search for cases. Run an eCourts check on the donor and seller, and ask the seller in writing whether any petition is pending before the RDO's Maintenance Tribunal.
  5. Ask for the donor's consent in writing to this sale, and consider having the donor sign as a confirming party in the sale deed (lawyer's call), plus a newspaper public notice calling for claims, as the TG precautions page suggests.

Common mistake: thinking "it's registered, so it's final". Registration proves the gift was made; it does not stop a Tribunal declaring it void under s.23(1) if the gift carried a care condition that was broken. The child-seller may not mention a family dispute, so ask.

FAQ

Can a father cancel a gift deed he registered for his son in Hyderabad?

Not at will. Section 126 of the Transfer of Property Act allows revocation only on an agreed condition not depending on the donor's will, or where a contract could be rescinded (for example fraud). A gift revocable at the donor's mere will is void.

What does the Senior Citizens Act change?

Section 23(1): if a senior citizen gifted property on condition of being given basic amenities and needs, and the donee fails, the Maintenance Tribunal can declare the gift void at the donor's option. In Telangana the Tribunal is presided over by the RDO (to verify for your area).

I am buying from the person who received the gift. Am I safe?

Check the gift deed's conditions, whether the donor is alive, the EC and court records. Section 23(2) protects a paying buyer without notice only against the donor's maintenance claim. Ask a lawyer about anything more.

Does the EC show a gift deed was cancelled?

An EC lists registered documents, so a registered cancellation deed should appear. A pending tribunal petition will not appear; ask the seller and search eCourts.

How much is stamp duty on a gift deed in Telangana?

See our Telangana stamp duty page for sale and gift deeds; rates there are from the department's table (verify on the day you register).
