Development agreement in Telangana (Hyderabad): stamp duty and registration fee for joint development and DA cum GPA
Short answer: In Telangana, a plain development or construction agreement carries 0.5% stamp duty (not adjustable), and a development agreement cum GPA carries 1% (not adjustable), under G.O.Ms.No.59 of 20-07-2021 (in force from 22-07-2021). The registration fee table of 02-09-2021 lists 0.5%, minimum Rs 5,000 and maximum Rs 50,000 for an agreement to sell, construct or develop, and 0.5%, minimum Rs 5,000 and maximum Rs 1,00,000 for a development agreement cum GPA.
The rows that apply to joint development
- Development / construction agreement (G.O.Ms.No.59 table, row 2, Article 6(B)): stamp duty 0.5%, not adjustable.
- Development / construction agreement cum GPA (row 4, Articles 6(B) and 42): stamp duty 1%, not adjustable.
- Agreement to sell, construct or develop immovable property (fee table, Category 2, row 9): registration fee 0.5%, minimum Rs 5,000, maximum Rs 50,000.
- Development agreement cum General Power of Attorney (row 4): registration fee 0.5%, minimum Rs 5,000, maximum Rs 1,00,000.
- Separate power of attorney to sell, construct, develop or transfer: registration fee 0.5% with minimum Rs 2,000 and maximum Rs 20,000 when given to a family member (row 7), or minimum Rs 5,000 and maximum Rs 1,00,000 when given to anyone else (row 8). For the stamp duty on a stand-alone GPA, see our Telangana power of attorney guide.
"Not adjustable" means the duty paid on the agreement isn't set off later against the duty on the sale deeds for the flats.
How the caps change the total
Example only, not a quote: the numbers below assume a value of Rs 1 crore adopted by the Sub-Registrar, just to show how the percentages and caps work. Your value depends on the land, the proposed construction and the office's own working.
- Plain development agreement: stamp duty 0.5% of Rs 1 crore is Rs 50,000. The fee works out to Rs 50,000, which is also the row 9 maximum.
- Development agreement cum GPA: stamp duty 1% is Rs 1,00,000. The fee is 0.5%, Rs 50,000, which is inside the Rs 1,00,000 cap.

Value, stamping and doubts
- Market value: section 47A of the Indian Stamp Act as applied in Telangana names agreements relating to construction or development, and powers of attorney given for development, among the documents the Sub-Registrar can refer to the District Registrar if the value looks understated. Check the published value first with our market value guide.
- Paying the duty: non-judicial stamp papers in Telangana go up to Rs 100 only, and the balance is paid by challan (Stamps FAQ Q4). See our e-stamp and franking guide.
- Not sure which row applies: FAQ Q13 says you can apply to the District Registrar under section 31 for an opinion on the duty, with the draft deed, an affidavit on Rs 20 stamp paper and a Rs 15 fee.
- Signed abroad: FAQ Q7 says duty on a document executed outside India is paid within three months of its receipt in India, endorsed by the District Registrar. FAQ Q8 says a document signed in another state for Telangana property pays the deficit duty.

Landowner's checklist before signing
- Your own title and an EC for the land (Telangana EC guide)
- The published market value for the survey or plot number
- The developer's building permission once it is applied for (building permission and OC guide), and TG-RERA registration where the project needs it (how to verify a RERA project)
- Whether the GPA is inside the development agreement (1% duty) or a separate deed, so you know which rows you are paying
- A clear schedule of which flats or plots are the landowner's share, since the share later moves by its own deeds
