Partition deed and settlement deed charges in Telangana (Hyderabad): family stamp duty, registration fee and the separated-share sum
Short answer: In Telangana, a partition deed among family members carries stamp duty of 0.5% on the value of the separated shares, capped at Rs 1,00,000, and a flat registration fee of Rs 2,000. A settlement deed in favour of a family member carries 2% stamp duty and a registration fee of 0.5% (minimum Rs 2,000, maximum Rs 25,000). Duty is worked out on the government market value, and the largest share is left out of the partition sum.
The rows that matter
- Partition among family members (Article 40): 0.5% on the value of separated shares, subject to a maximum of Rs 1,00,000. Registration fee: Rs 2,000.
- Partition in other cases: 2.5% on the value of separated shares. Registration fee: 0.5%, minimum Rs 2,000, maximum Rs 1,00,000.
- Settlement in favour of a member or members of the family (Article 49-A(a)): 2%. Registration fee: 0.5%, minimum Rs 2,000, maximum Rs 25,000.
- Settlement in other cases (Article 49-A(b)): 3.5%. Registration fee: 0.5%, minimum Rs 2,000, maximum Rs 1,00,000.
- Release in favour of a family member: registration fee 0.5%, minimum Rs 2,000, maximum Rs 25,000 (Rs 1,00,000 maximum for others). The stamp duty row for a release isn't in the G.O. extract we read (to verify at the Sub-Registrar).
Who counts as family: the fee notification defines a family member as father, mother, husband, wife, brother, sister, son, daughter, and includes grandfather, grandmother, grandchild, adoptive father or mother, and adopted son or daughter.
How the separated-share sum works
The Stamps FAQ (Q22) gives this example. Three family members split a property: A gets a share worth Rs 5,00,000, B gets Rs 4,00,000 and C gets Rs 3,00,000. The largest share (A's) is left out, so duty is charged on B and C's shares, Rs 7,00,000 in all. At 0.5% that is Rs 3,500. If all shares are equal, one share is left out.
Note on the cap: that FAQ answer still prints the cap as Rs 20,000. G.O.Ms.No.59 of 2021, the later order, prints Rs 1,00,000. We show the G.O. figure. The difference only shows when the separated shares are worth more than Rs 40 lakh (0.5% of Rs 40 lakh is Rs 20,000). The Rs 1,00,000 cap is reached at Rs 2 crore of separated shares. For bigger family properties, ask the Sub-Registrar which cap they apply (to verify).
The value used is the market value fixed by the Government committees, not a figure you choose. The Sub-Registrar gives a market value slip; see our Telangana market value check. The value taken for stamp duty is also the value for the registration fee.
Five rules from the official FAQs
- Partition by deed must be registered. Registration FAQ Q4: if partition is effected through an instrument, it must be compulsorily registered, and stamp duty is payable on any kind of partition.
- Everyone with a share can partition. Q4 again: partition can be effected if all parties have a share (common right) in the property, and shares can be unequal if the parties agree.
- Heirs can buy out a sibling. Registration FAQ Q5: where there are two or more heirs, one or two can become full owners while others take money for their share, by partition or by release, as the parties wish.
- Who pays. Stamps FAQ Q12: for a partition deed, all parties pay stamp duty in proportion to their share.
- Unpaid duty has consequences. Stamps FAQ Q14: a document without the duty due can't be received in evidence, will be impounded if presented to a public officer, and duty plus penalty will be levied.
Which deed fits your family (partition, settlement, release or gift) changes who owns what and what tax may follow. That is a legal choice for your lawyer. This page only shows the published duty and fee rows and how the separated-share sum works.
