Partition deed and settlement deed charges in Andhra Pradesh (Vizag, Vijayawada): family stamp duty, registration fee, worked example

Official documents read 14 to 19 Oct 2026 · Not legal advice · Government websites change, so re-check before you rely on a step.

Short answer: The Andhra Pradesh IGRS Stamp Duty FAQ says a partition among a joint family pays 1% stamp duty on the value of the separated shares, with the largest share left out, and the IGRS fee table lists a flat Rs 1,000 registration fee for partition. A settlement in favour of a family member is listed at 3% stamp duty in the same FAQ, with a registration fee of 0.5% (minimum Rs 1,000, maximum Rs 10,000). The FAQ is undated, so confirm both rates at the Sub-Registrar office before you pay.

Read from PDFs on the AP IGRS website (registration.ap.gov.in), downloaded by us on 15 Oct 2026. The Stamp Duty FAQ was re-read on 19 Oct 2026. The fee table states it is in force from 01.09.2013; whether any row has been revised since is to verify.

The rows that matter

Who counts as family (FAQ Q23): mother, father, son, daughter, brother, sister, wife, husband, adopted father, adopted mother, adopted son, adopted daughter, grandfather, grandmother, grandson and granddaughter.

How the separated-share sum works

FAQ Q22 gives this example. A gets a share worth Rs 5,00,000, B gets Rs 4,00,000 and C gets Rs 3,00,000. A's share, the largest, is left out, so duty is charged on Rs 7,00,000. At 1% that is Rs 7,000. If all shares are equal, one share is left out.

The Stamp Act schedule published on IGRS (Article 40, note) says the same thing in legal words: the largest share remaining after partition is treated as the one the others are separated from. It also says that where a partition follows a court or revenue order, or an arbitration award, that was already stamped as a partition, the later deed's duty "shall not exceed five rupees" (ask your lawyer whether that applies to you).

The value used is the market value under section 47A, not a figure you choose. See our AP market value check.

Who pays

FAQ Q12: for a partition deed, all the parties pay stamp duty in proportion to their share. For a settlement, the same answer says the person drawing, making or executing the instrument pays.

Which deed fits your family (partition, settlement, release or gift) changes who owns what and what tax may follow. That is a legal choice for your lawyer. This page only shows the published duty and fee rows and how the separated-share sum works.
