Sale deed signed but not registered in Andhra Pradesh: four-month rule, penalty and NRI deeds from abroad
Short answer: AP's Registration department gives a buyer four months from the day the deed is signed to present it at the Sub-Registrar office without any penalty. A further four months are possible only if the District Registrar condones the delay for unavoidable circumstances and collects a penalty, capped at ten times the registration fee. The IGRS registration procedure note says no document is accepted once eight months from signing have passed. A deed signed outside India gets four months from the day it arrives in India, and you may have to prove that date.
Who this is for: anyone buying a flat, house or plot in Visakhapatnam, Vijayawada, Guntur, Tirupati or elsewhere in Andhra Pradesh whose deed is already signed but not yet registered, and NRI families who sign papers overseas and send them to AP.
What AP IGRS and the Registration Act say
| Issue | Source and text | Status |
|---|---|---|
| Penalty-free window | IGRS Document Registration note: the document "shall be presented before the Registering Officer within four months from the date of signing". The central rule is s.23 of the Registration Act, 1908 (wills excepted). | Read 25 Oct 2026 |
| Late presentation | Same IGRS note: where parties cite unavoidable circumstances, "the Registrar may condone the delay after collecting the penalty", and the delay "shall not exceed four months". AP IGRS FAQ Q22: penalty subject to a maximum of ten times the registration fees, if the District Registrar grants permission (s.25 of the Act). | Read 25 Oct 2026 |
| Hard stop | IGRS note: "no document shall be accepted for registration after lapse of eight months from the date of signing (execution) by the parties." | Read 25 Oct 2026 |
| Executant appears late | s.34(1) proviso: when the persons who signed cannot appear in time due to urgent necessity or unavoidable accident, and the delay in appearing is up to four months, the Registrar may permit registration with a separate fine of up to ten times the fee, in addition to any s.25 fine. | Read 25 Oct 2026 |
| Signed outside India | IGRS note: may be presented within four months after its arrival in India; the presenter may have to prove the arrival date with evidence such as a courier delivery receipt or an affidavit from the person who carried it. Act s.26 sets the same rule. | Read 25 Oct 2026 |
| Wills and GPA | IGRS note: wills can be presented at any time, even after the testator's death (with an enquiry). FAQ Q10: no time limit for a will. | Read 25 Oct 2026 |
| Size of the fee | AP Table of Fees, G.O.Ms.No.463 (2013) on the IGRS site lists 0.5% for a sale. The penalty cap is a multiple of the proper fee. We did not confirm whether this 2013 table is the current rate; see our AP stamp duty and registration charges guide. | 2013 GO read 25 Oct 2026; current rate to verify |
Practical plan for an AP sale deed
- Mark day 1 as the signing date, not the agreement date. The clock in the IGRS note starts from signing (execution). Put day 120 in your calendar as the last penalty-free day, and day 240 as the date after which IGRS says the deed is dead.
- Prepare through Public Data Entry and book the slot together. The IGRS procedure describes the free PDE module; generating the document and booking your AP slot in the same week keeps signing and presentation close. Carry what the AP SRO checklist lists.
- Late by less than four months? Apply through the Sub-Registrar to the District Registrar with written reasons and evidence of the unavoidable circumstance. Expect a penalty decided by the Registrar within the ten-times cap, plus a possible separate fine if an executant also appeared late.
- Deed coming from abroad? Keep the courier tracking page and delivery receipt, or an affidavit from the relative who carried it, showing the arrival date in India. Powers of attorney signed overseas need attestation (FAQ Q32). Our AP NRI power of attorney page explains the stamp side.
- Past eight months? IGRS will not accept it. Talk to a lawyer about executing a fresh deed and check the AP stamp refund rules for the duty already paid.
Common mistake: an NRI seller signs in Dubai or the US, the original sits with a relative for months, and nobody records when it landed in India. Without proof of the arrival date, the Sub-Registrar may count from the signing date and treat the deed as late. FAQ Q21 also reminds buyers that an unregistered deed is not admissible in evidence (s.49).
