Sub-Registrar refused to register your document in Hyderabad or Telangana? Appeal to the District Registrar

Official pages read on 24 Oct 2026 · Not legal advice · Government websites change, so re-check before you rely on a step.

Short answer: if a Sub-Registrar in Hyderabad or anywhere in Telangana refuses your sale deed, gift deed or other document, first ask for the written reasons. Under section 71 of the Registration Act, 1908 the Sub-Registrar must record the reasons in Book No. 2, endorse "registration refused" on the document and give you a copy of the reasons free on request. What you do next depends on the reason. If the seller (executant) denied signing or did not turn up, you apply to the District Registrar within 30 days (section 73). For most other reasons you appeal to the District Registrar within 30 days (section 72). If the District Registrar also refuses, a civil suit can be filed within 30 days (section 77). The Telangana Registration FAQ (Q25) describes the same path.

This guide is for buyers whose deed was stopped at the counter. If you have not reached the office yet, see the documents checklist for the Sub-Registrar office first.

Common refusal reasons in Telangana and the route for each

Reason givenWhat the official text saysYour route
Property is on the prohibited (22-A) listFAQ Q18 lists the section 22-A classes: land whose transfer a statute prohibits, Government land sold by someone not empowered, endowment or wakf land, ceiling or urban-ceiling surplus land, and notified properties.A District Registrar appeal does not remove a land entry. Ask why it is listed; the Registration home page has a "Prohibition Grievances" status link. See our prohibited property check.
Seller denied execution or did not appearFAQ Q25: the office issues notice or summons; if the executant still does not come, registration is refused and you may apply to the District Registrar, who holds an enquiry (fee payable).Section 73 application within 30 days: in writing, with a copy of the section 71 reasons, verified like a plaint.
Document presented too lateFAQ Q21: present within four months of signing (for a deed signed abroad, from its first receipt in India); a further four months only with the District Registrar's permission and a penalty of up to ten times the registration fee; after eight months it cannot be accepted.Within the second four months, apply to the District Registrar. After eight months, ask your lawyer about a fresh deed.
No identifying witnessesFAQ Q27: two identifying witnesses are taken; without them the registering officer may refuse.Usually fixed by returning with two witnesses. Ask the office before filing an appeal.
Power of attorney not attested properlyFAQ Q36: a special power of attorney signed in India must be attested by a Sub-Registrar; one signed abroad by a Notary, consul or vice-consul. Otherwise it is not accepted.Get a properly attested power (see our NRI power of attorney guide), then present again.

What to do in the first 30 days after a refusal in Telangana

  1. Day 0: keep the document. Note the date of the refusal order. The 30-day limits in sections 72, 73 and 77 count from the order.
  2. Ask for the reasons in writing. Section 71 says a copy is given free and without unnecessary delay to the executant or claimant.
  3. Sort the reason into one of the rows above. A missing witness or paper is often fixed by presenting again; a denial of execution or a dispute needs the District Registrar.
  4. File with the District Registrar to whom that Sub-Registrar is subordinate. Attach the reasons, the deed, ID and challan copies. For a denial of execution, the application must be verified like a plaint (section 73(2)).
  5. If the District Registrar orders registration, present the document again within 30 days of that order (sections 72(2) and 75(2)). It then counts as registered from the date you first presented it.
  6. If the District Registrar refuses, section 77 allows a suit in the civil court within 30 days. This needs a lawyer.
  7. Protect the money. Do not release the balance to the seller until the deed is registered. Read your agreement's refund clause with your lawyer.

Common mistake: paying an agent to "manage" the refusal. The Registration home page warns that payments go only through the pre-registration slot booking module, eSTAMPS or the Meeseva app, and that no payment link is sent by SMS. Refusals are reversed on the record, not off it.
