Auction property sale certificate in Telangana (Hyderabad): stamp duty and registration fee
Short answer: In Telangana, a certificate of sale given to the buyer of a property sold at public auction is listed at 5% stamp duty, 0% transfer duty and a 0.5% registration fee, charged on the amount of the purchase money (Telangana Registration and Stamps Ready Reckoner, row 7). A normal sale deed outside Gram Panchayat areas is listed at 5.5% + 1.5% + 0.5% on the market value or consideration, whichever is higher.
The row, as published
- Row 7, Certificate of Sale: stamp duty 5.00%; transfer duty 0.00%; registration fee 0.50%; chargeable value "value equal to the amount of purchase money".
- For comparison, rows 1 and 2, Sale Deed: in a Gram Panchayat 5.5% duty and 2% fee; in other areas 5.50% duty, 1.50% transfer duty and 0.50% fee; chargeable value "market value or consideration, whichever is higher".
Who pays: the Telangana Stamps FAQ (Q12) says that, unless agreed otherwise, for a "certificate of sale on auction of property" the stamp is borne by the purchaser.
Filing: the Telangana Registration FAQ (Q29) lists a "certificate of sale issued by revenue court" among documents that are sent to the office under section 89 of the Registration Act and filed, without the parties appearing in person. How your own certificate reaches the office depends on who issued it (to verify).
How it adds up
Example only, not a quote: from row 7; user charges and rounding are extra or to verify.
- Auction purchase money Rs 40,00,000: stamp duty 5% = Rs 2,00,000; transfer duty 0% = Rs 0; fee 0.5% = Rs 20,000; total Rs 2,20,000.
- Auction purchase money Rs 75,00,000: duty Rs 3,75,000; fee Rs 37,500; total Rs 4,12,500.
- Comparison only: a sale deed in "other areas" at a Rs 40,00,000 value would be 5.5% + 1.5% + 0.5% = 7.5%, or Rs 3,00,000, and on the market value if that is higher (market value guide).
Three things to ask the Sub-Registrar first
- Bank auctions: the row is titled "Certificate of Sale". The Andhra Pradesh stamp schedule wording for the same instrument names sales by a civil or revenue court, Collector or other revenue officer. Whether a sale certificate issued by a bank's authorised officer is charged under this row in Telangana is not stated on the page we read (to verify).
- Separate lots: if you bought more than one lot, ask whether duty is worked out lot by lot.
- Value used: the row says purchase money, not market value. Confirm the office applies it that way to your certificate before paying (to verify).
Whether to bid, what the auction terms mean, and how a bank or court sale affects your title are questions for your own lawyer. This page only lists the published duty and fee rows and what the department's own FAQs say. Not legal advice.
