Auction property sale certificate in Andhra Pradesh (Vizag, Vijayawada): stamp duty and registration fee
Short answer: In Andhra Pradesh, a certificate of sale for a property bought at public auction is listed at 4% stamp duty, a 0.50% registration fee and Rs 200 user charges (IGRS duty and fee table, row 16). The stamp schedule charges it on the amount of the purchase money only.
The rules, as published
- IGRS table row 16, Certificate of sale: stamp duty 4%; registration fee 0.50%; user charges Rs 200.
- Stamp schedule: a certificate of sale "in respect of each property put up as a separate lot and sold", granted to the purchaser of property sold by public auction by a civil or revenue court, or Collector or other revenue officer, pays the same duty as a conveyance on a value equal to the amount of the purchase money only. Its note says the rate was reduced to 4% by G.O.Ms.No.582, Revenue (Regn-I) Department, dated 30.11.2013, from 02.12.2013.
- Fee G.O.Ms.No.463 dated 17.08.2013, row 11: certificate of sale 0.5%, with no minimum or maximum printed.
Who pays: the AP Stamp Duty FAQ says that for a "certificate of sale on auction of property" the stamp is borne by the purchaser, unless agreed otherwise.
Filing: the AP Registration FAQ (Q30) lists a "certificate of sale issued by revenue court" among documents sent under section 89 of the Registration Act and filed, without personal appearance. For other issuers, ask the office (to verify).
How it adds up
Example only, not a quote: from row 16; rounding and vendor charges are extra or to verify.
- Auction purchase money Rs 40,00,000: duty 4% = Rs 1,60,000; fee 0.5% = Rs 20,000; user charges Rs 200; total Rs 1,80,200.
- Auction purchase money Rs 75,00,000: duty Rs 3,00,000; fee Rs 37,500; user charges Rs 200; total Rs 3,37,700.
- Two lots bought for Rs 20,00,000 each: if each lot gets its own certificate, each one is Rs 80,000 + Rs 10,000 + Rs 200 = Rs 90,200 (whether user charges apply per certificate is to verify).
Three things to ask the Sub-Registrar first
- Bank auctions: the schedule wording names courts, the Collector and revenue officers. Whether a sale certificate issued by a bank's authorised officer is charged under the same row is not stated in what we read (to verify).
- Value used: the schedule says purchase money only. Confirm the office applies that to your certificate, not the market value (AP market value guide).
- Later revisions: the 4% rate dates from 2013. Run the IGRS Duty Fee Calculator before paying.
Whether to bid, what the auction terms mean, and how a bank or court sale affects your title are questions for your own lawyer. This page only lists the published duty and fee rows and what the department's own FAQs say. Not legal advice.
