Exchange deed in Telangana (Hyderabad): stamp duty and registration fee for swapping land, plots or flats
Short answer: In Telangana, an exchange of property deed carries 5% stamp duty (Article 27, row 7 of G.O.Ms.No.59 of 20-07-2021, in force from 22-07-2021). The registration fee table of 02-09-2021 lists 0.5% for an exchange of property in any area except a Gram Panchayat, and 2% for property in a Gram Panchayat. There is no maximum on either fee row. The Stamps FAQ says that, unless the parties agree otherwise, both parties pay the stamp duty equally.
The rows that apply to an exchange
- Stamp duty, exchange of property (G.O.Ms.No.59 table, row 7, Article 27): 5%. The table does not say which of the two properties the 5% is worked on. The Stamps FAQ (Q18) says duty on an exchange is levied on market value, so ask the Sub-Registrar which value they will adopt (to verify).
- Registration fee, exchange, any area except Gram Panchayat (Category 1, row 2(a)): 0.5%.
- Registration fee, exchange, property in a Gram Panchayat (row 2(b)): 2%.
- Not in these tables: transfer duty and any user charges. Ask the Sub-Registrar office for the full total, or use the department's duty and fee calculator.
Compare: a gift to a family member is 2% duty and a sale is 5.5% under the same G.O. (see our Telangana sale and gift deed charges guide). Dividing family property among co-owners is a partition, not an exchange (see the partition and settlement deed guide).
How it adds up
Example only, not a quote: the numbers assume two plots whose values adopted by the Sub-Registrar are Rs 60 lakh and Rs 40 lakh, just to show how the percentages work. Your values come from the published market value and the office's own working.
- If the higher value is adopted (Rs 60 lakh): stamp duty 5% is Rs 3,00,000, shared Rs 1,50,000 each if neither party agreed otherwise. Registration fee outside a Gram Panchayat at 0.5% is Rs 30,000.
- Same plots in a Gram Panchayat: the fee at 2% would be Rs 1,20,000, so the location row matters a lot.
Transfer duty and charges come on top. Check both plots' published values first with our market value guide.
What the Stamps FAQ adds
- Who pays: "In case of exchange deed both parties equally" (Q12), in the absence of an agreement to the contrary.
- Value dispute: if you don't accept the market value slip, the Sub-Registrar can keep the document pending and refer it to the District Registrar under section 47A after collecting 50% of the deficit duty as a deposit (Q18).
- Not sure of the row: you can ask the District Registrar for an opinion under section 31 with the draft deed, an affidavit on Rs 20 stamp paper and a Rs 15 fee (Q13).
- Under-stamped deed: it can't be received in evidence and can be impounded with a penalty (Q14). Paying the deficit voluntarily within one year of signing is accepted without penalty (Q16).
Whether a swap should be an exchange deed, two sale deeds, a gift or a partition, and any income tax on it, are questions for your own lawyer or tax adviser. This page only lists the published stamp duty and registration fee rows and what the department's FAQ says. Not legal advice.
