Home loan mortgage (deposit of title deeds, MODT) in Telangana (Hyderabad): registration fee and stamp duty
Short answer: When you take a home loan in Telangana and the bank keeps your title deeds (a mortgage by deposit of title deeds, often called MODT), the 2021 registration fee table charges 0.1% of the loan amount, capped at Rs 10,000 (Category 2, row 10). Releasing that mortgage after you repay is a flat Rs 2,000 (Category 3, row 2). The stamp duty is not in the 2021 stamp duty G.O.Ms.No.59, so it is to verify with the Sub-Registrar office.
The fee rows that apply to a home loan
- Deposit of title deeds (Category 2, row 10, "Agreement relating to Deposit of Title Deeds falling under Article 7(a) of the Schedule IA", with or without a pari passu charge for more than one lender): 0.1%, maximum Rs 10,000.
- Any other mortgage (Category 1, row 8(a)): 0.1%, with no cap printed.
- Mortgage with possession in a Gram Panchayat area (Category 1, row 8(b)): 1.6%.
- Release of mortgage, release of deposit of title deeds, or re-conveyance (Category 3, row 2): Rs 2,000 flat.
Stamp duty: what we can and can't say
- We hold no official Telangana row for stamp duty on a deposit of title deeds, so we don't print a number. Ask the Sub-Registrar office, or ask the District Registrar for a section 31 opinion (Stamps FAQ Q13).
- Duty is charged on the loan amount, not on the interest that will build up (Stamps FAQ Q9).
- For a mortgage by deposit of deeds, the duty is paid by the person who signs it, which is usually the borrower, unless agreed otherwise (Stamps FAQ, "who is liable").
- If the same property is later sold to the mortgagee, the duty already paid on the mortgage deed can be deducted (Stamps FAQ Q10).
How the fee adds up
Example only, not a quote: registration fee only; stamp duty and any user charges are extra and to verify.
- Rs 60 lakh home loan: 0.1% = Rs 6,000 (under the Rs 10,000 cap).
- Rs 1.5 crore home loan: 0.1% = Rs 15,000, so the cap applies and the fee is Rs 10,000.
- After you repay: the release deed fee is Rs 2,000, whatever the loan size.
Compare: the sale deed itself carries 5.5% stamp duty in Telangana (see our Telangana sale and gift deed charges guide), so for most buyers the mortgage fee is small next to the purchase cost.
Your loan terms, what the bank asks you to sign, and whether a mortgage needs registering in your case are questions for your bank and your own lawyer. This page only lists the published fee and duty rows and what the department's own papers say. Not legal advice.
